The 2016-2017 Edition of the FERC Manual retains the essential structure andcontent of earlier editions, updated to take into account developments in a varietyof areas and expanded to include subjects that previously were not included.

The new subjects reflect recent Federal Energy Regulatory Commission (“FERC”)orders and rules and related court decisions that reflect changes occasionedby substantially increased supply and declining prices of natural gas, as well aschallenges to its potential as a fuel of choice due to new environmental and safetyinitiatives. As natural gas has become an increasingly prominent fuel for electricgeneration, FERC has concluded its multi-year investigation into coordinationof the gas and electric industries and made significant but not radical policychoices. During this past year FERC’s policies and decisions reflected incrementaldevelopments rather than substantial new initiatives, including:

  • the treatment of revenue credits for released capacity;
  • non-conforming tariff provisions for anchor shippers;
  • implementing its gas-electric harmonization rules by approving information sharingtariff provisions and establishing “default” recall specifications fortransactions that span new timely nomination cycles;
  • implementing policies to require posting by pipelines of offers to purchasereleased capacity; and
  • withstanding a motion to dismiss, enforcement efforts that sought to applypenalties to individuals.

This edition of the FERC Manual recounts those developments but also providesadditional history to introduce the reader to some of the colorful background ofthe industry’s earliest days, the competition and battles that led to Federal TradeCommission (“FTC”) and Congressional investigations and, in turn, to enactment ofthe Natural Gas Act (“NGA”).

Additionally, new graphics have been added to illustrate the relationship of thevarious segments of the industry as well as an entirely new chapter on the appellateprocess.
